Tickets issued under the Highway Traffic Act, Insurance Act or Criminal Code appear on your driver's abstract and can affect your insurance rate. Car insurance rates between auto insurance companies can vary by hundreds, even thousands of dollars. The easiest way to find which insurance companies offer the lowest prices is to do an online rate search. 

Tickets are divided into 3 classifications: minor, major and serious convictions, which include criminal acts. All ticket classifications, regardless of demerit points, can affect your insurance rate.

Parking tickets do not affect your driver’s licence, insurance record or appear on your driver’s abstract. The only consequence of not paying a parking ticket means that your license plate will not be renewed. You must still renew your license plate every year with the MTO, at no cost.  However, you will no longer receive a sticker to affix to the plate.

Demerit Points

Most infractions come with demerit points. The more serious the infraction is, the more demerit points it will cost you. If you reach between 7-9 demerit points, your licence may be suspended temporarily. You could also receive a warning letter indicating your driver’s licence may be suspended if you accumulate any more points. A contributing factor as to how long your licence will be suspended for or whether it will be cancelled, will depend on the class of licence you have.

If you have a G1 or G2 class driver’s licence and are convicted of a 4 demerit point offence or higher, you will receive an automatic minimum 30-day suspension.

By themselves, demerit points do not affect your insurance premium. Tickets can increase your premiums regardless of how many demerit points they earn you. However, a consequence of gaining demerit points is getting your licence suspended and this will cause your premiums on your car insurance to increase significantly. So, overall, the type of infraction you commit does end up having an effect on your car insurance policy.

Did you miss your court date and were convicted of the offence in your absence? If you have been convicted of an offence because you did not attend the court date for good reason, the court office made an error, or you simply did not receive your Notice of Trial date, then an application to the court can be made to reopen your matter. This procedure can correct the mistake in order to remove the conviction from your driving record, pending the hearing of a new court date. However, this process must be done within fifteen days (15) of you becoming aware of the conviction.

Appeals

Another process to rectify a wrongful conviction would be an Appeal. Appeals are very difficult to prepare and argue, and require special procedures to make them valid and perfected. There are many reasons that would justify filing an appeal application such as, but not limited to, improper representation, the Justice of the Peace made an error with the facts or law at trial, you were convicted in your absence of no fault of your own, and an improper or unjust sentence. An ill prepared appeal can keep you from getting the justice you deserve.
